{"id":7928,"date":"2011-10-21T07:58:44","date_gmt":"2011-10-21T05:58:44","guid":{"rendered":"https:\/\/www.lhr-law.de\/?p=7928"},"modified":"2017-04-07T12:24:13","modified_gmt":"2017-04-07T11:24:13","slug":"filesharing-universitaten-in-den-usa-exmatrikulieren-studenten-nach-wiederholten-urheberrechtsverstosen","status":"publish","type":"post","link":"https:\/\/www.lhr-law.de\/en\/magazin\/filesharing-universitaten-in-den-usa-exmatrikulieren-studenten-nach-wiederholten-urheberrechtsverstosen\/","title":{"rendered":"Filesharing: Universit\u00e4ten in den USA exmatrikulieren Studenten nach wiederholten Urheberrechtsverst\u00f6\u00dfen"},"content":{"rendered":"<p style=\"text-align: justify\"><img decoding=\"async\" class=\"ngg-singlepic ngg-left alignleft\" style=\"margin-right: 15px;margin-bottom: 10px\" title=\"Die Biber bauen D\u00e4mme\" src=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2011\/10\/OSUBeavers.gif\" alt=\"\" \/><\/p>\n<p>Amerikas Universit\u00e4ten nehmen Filesharing innerhalb ihrer Netzwerke nicht auf die leichte Schulter.<\/p>\n<p>An der <a href=\"http:\/\/oregonstate.edu\/fa\/manuals\/gen\/file-sharing\" target=\"_blank\">Oregon State University<\/a> zum Beispiel werden alle Studenten E-Mail und auf der universit\u00e4tseigenen Website explizit darauf hingewiesen, dass insbesondere die Nutzung und die Verbreitung von urheberrechtlich gesch\u00fctztem Material, wie zum Beispiel Musik und Filmen illegal und mit Strafen von bis zu f\u00fcnf Jahren Gef\u00e4ngnis und 250.000 $ Geldstrafe geahndet werden k\u00f6nnen.<\/p>\n<p>Die Universit\u00e4t selbst h\u00e4lt ebenfalls Sanktionen bereit. Beim erstmaligen Versto\u00df m\u00fcssen die Studenten noch lediglich eine Pr\u00fcfung mit Fragen zum Urheberrecht bestehen, um ihren Internetanschluss zu behalten.<\/p>\n<p>Weitere Verst\u00f6\u00dfe sollen nach den Regeln der Universit\u00e4t aber dann zu drakonischeren Strafen bis hin zur Exmatrikulation f\u00fchren.<\/p>\n<p>Der Wortlaut der Anfang Oktober an alle Studenten versandten E-Mail lautet wie folgt<\/p>\n<blockquote><p>OSU\u2019S Policy Regarding Unauthorized Peer-to-Peer (P2P) File Sharing and Other Copyright Infringement<\/p>\n<p>Institutional policies and sanctions related to the unauthorized distribution of copyrighted material:<\/p>\n<p>The University takes copyright infringement seriously. As set forth in the Acceptable Use of University Computing Resources policy (located at http:\/\/oregonstate.edu\/aup.htm), all students must abide by federal and state copyright laws when using University computing or network resources. The unauthorized publishing or use of copyrighted material on the University computer network is strictly prohibited and users are personally liable for the consequences of such unauthorized use. This specifically applies to Peer-to-Peer or P2P file-sharing of copyrighted music and movies. Students should be aware that by engaging in unauthorized sharing of copyrighted material, they not only violate University policy, but they may also be held criminally and civilly liable by federal and\/or state authorities.<\/p>\n<p>Under current copyright law, criminal cases of copyright violation carry a penalty of up to five (5) years in prison and a $250,000 fine. Civil penalties for copyright infringement include a minimum fine of $750 for each work. Oregon State University will subject students who violate this policy to discipline as appropriate. For a first-time violation of this copyright policy, students are required to pass a copyright quiz within 72-hours or else their network access is disabled.
