M.<\/span>, <span class=\"etyp\">Urteil<\/span> v.\u00a0<span class=\"datum\">26.10.2017, Az.<\/span>\u00a0<span class=\"az\"><a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=6%20U%20154\/16\" title=\"6 U 154\/16 (2 zugeordnete Entscheidungen)\">6 U 154\/16<\/a>)<\/span>. This neither from <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/trademark-law\/\">trademark law<\/a> still from <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/competition-law-antitrust-law\/competition-law\/\">Competition law<\/a>.<\/p>\n<h2>The parties<\/h2>\n<p>The defendant has been operating an online shop for electronic devices, in particular notebooks, laptops and software, under the domain www.notebooksbilliger.de since 2008:<\/p>\n<p><img decoding=\"async\" class=\" wp-image-35807 aligncenter\" src=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilliger.jpg\" alt=\"\" width=\"466\" height=\"247\" srcset=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilliger.jpg 468w, https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilliger-90x48.jpg 90w\" sizes=\"(max-width: 466px) 100vw, 466px\" \/><\/p>\n<p>It is the proprietor of national word\/figurative mark No. 30407225, which was applied for on 12 February 2004 and registered on 29 April 2004 for, inter alia, computers and computer software:<\/p>\n<p><img decoding=\"async\" class=\"wp-image-35809 aligncenter\" src=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilligermarke.jpg\" alt=\"\" width=\"469\" height=\"75\" srcset=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilligermarke.jpg 1713w, https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilligermarke-90x14.jpg 90w, https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilligermarke-768x123.jpg 768w, https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/notebooksbilligermarke-620x99.jpg 620w\" sizes=\"(max-width: 469px) 100vw, 469px\" \/><\/p>\n<p>The plaintiff was founded in May 2011. It sells notebooks, desktop PCs and accessories under the domain software-billiger.de:<\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-35811 aligncenter\" src=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/softwarebilliger.jpg\" alt=\"\" width=\"468\" height=\"248\" srcset=\"https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/softwarebilliger.jpg 468w, https:\/\/www.lhr-law.de\/wp-content\/uploads\/2017\/11\/softwarebilliger-90x48.jpg 90w\" sizes=\"(max-width: 468px) 100vw, 468px\" \/><\/p>\n<h2>Defendant issued unjustified property right warning<\/h2>\n<p>In September 2015, the defendant sent the plaintiff a warning letter. In the warning letter, it accused the plaintiff of having modelled the design of its online shop on that of the defendant. The interplay between the elements of a white background, an orange-red colour for the logo \u2018softwarebilliger.de\u2019 and a white arrow on an orange background in the browser title bar would create confusion or mislead. The plaintiff is thus committing an infringement of trade mark law as well as an infringement of competition law.<\/p>\n<h2>An infringement did not exist<\/h2>\n<p>As the Regional Court of Frankfurt (LG Frankfurt, Urteil v. <span class=\"datum\">23.6.2016<\/span>\u00a0, Az. 2\/<a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=3%20O%20413\/15\" title=\"LG Frankfurt\/Main, 23.06.2016 - 3 O 413\/15\">3 O 413\/15<\/a>) the Frankfurt Higher Regional Court also agreed with the plaintiff that the defendant was not entitled to any claims &#8211; neither under trade mark law nor competition law. The Senate carefully examined the case from both a trade mark law and competition law perspective and stated the following in particular in its reasons, which are well worth reading.<\/p>\n<p>It could even be assumed in favour of the defendant that the weak original distinctiveness &#8211; already at the time of the warning &#8211; had been increased through use. This is because there is a lack of sufficient similarity between the signs. The similarity in the element \u2018billiger.de\u2019 was not sufficient to assume a phonetic or visual similarity. There was also no notorious reputation.<\/p>\n<p>Misleading competition law is also ruled out. The word components \u2018notebooksbilliger.de\u2019 and \u2018softwarebilliger.de\u2019 would be clearly distinguished by the public.<\/p>\n<h2>The guiding principles of the decision<\/h2>\n<p>The Senate has released the decision for publication with the following guiding principles:<\/p>\n<ol>\n<li class=\"leitsatz-amtlich\">\n<blockquote><p>There is no likelihood of confusion under trade mark law between a word\/figurative mark with the word element \u2018notebooksbilliger.de\u2019 and the domain name \u2018software-billiger.de\u2019, even if the goods are identical and the trade mark is well known. (Rn. 18 \u2013 23)<\/p><\/blockquote>\n<\/li>\n<li class=\"leitsatz-amtlich\">\n<blockquote><p>In the case referred to in point 1, misleading information is deemed to exist from the point of view of the likelihood of confusion under unfair competition law. (<span class=\"zit\">\u00a7 <a href=\"https:\/\/beck-online.beck.de\/?typ=reference&amp;y=100&amp;g=UWG&amp;p=5\">5<\/a> II UWG<\/span>) can only be considered if, in addition to the approximation to the foreign trade mark &#8211; which is not objectionable under trade mark law &#8211; there are further circumstances, such as the adoption of design elements from the presentation environment, which played no role in the assessment under trade mark law and are likely to give rise to a concrete likelihood of confusion (im Streitfall verneint). (Rn. 27)<\/p><\/blockquote>\n<\/li>\n<\/ol>\n<p>Disclosure: Our law firm represented the plaintiff.<\/p>\n<p>As an aside: The Frankfurt Higher Regional Court published the decision just a few days after the parties had been served with it, well before the expiry of the appeal period (an appeal against denial of leave to appeal would be possible) and without sufficiently identifying the parties. The decision could therefore not be analysed by the parties beforehand and further action could not be adequately examined.
