However, not with regard to substantive legal issues, but to the procedural peculiarities of the preliminary injunction proceedings &#8211; in this case the enforcement requirement, which the applicant failed to meet due to an error by the bailiff. <\/i><\/p>\n<p><i>In addition, the decision of the Court of Appeal deals with the question of what function the postal service certificate has for the proof of the object of service and to what extent the defendant, who claims the lack of execution, may have a secondary burden of proof.<\/i><\/p>\n<h2>Asserting claims for injunctive relief is not easy<\/h2>\n<p>The assertion of claims for injunctive relief, as described in the <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/trademark-law\/\">Trademark law<\/a>, <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/competition-law-antitrust-law\/competition-law\/\">Competition law<\/a>, <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/copyright-design-law\/\">Copyright<\/a> and <a href=\"https:\/\/www.lhr-law.de\/en\/thema\/media-law\/\">Personal rights<\/a>\u00a0are mainly the subject of disputes is difficult.<\/p>\n<p>In the following four articles, we have already highlighted some of the problems in actual cases from our practice:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.lhr-law.de\/en\/magazine-en\/competition-law-antitrust-law\/application-for-injunctive-relief-and-urgency-on-the-difficulties-of-preliminary-injunction-proceedings-part-1\/\">Application for injunctive relief and urgency &#8211; On the difficulties of preliminary injunction proceedings<\/a><\/li>\n<li><a href=\"https:\/\/www.lhr-law.de\/magazine-en\/copyright-design-law\/doppelte-verneinung\/\">The omission of the omission: No urgency in the event of a double denial in the application<\/a><\/li>\n<li><a href=\"https:\/\/www.lhr-law.de\/magazine-en\/copyright-design-law\/schwierigkeiten-des-unterlassungsantrags-im-gewerblichen-rechtsschutz\/\">Not urgent, inadmissible, unfounded &#8211; On the difficulties of applying for injunctive relief in intellectual property law<\/a><\/li>\n<li><a href=\"https:\/\/www.lhr-law.de\/magazine-en\/sports-law\/mehr-ist-weniger-die-antragsfassung-beim-unterlassungsanspruch\/\">More is less &#8211; The version of the application for injunctive relief<\/a><\/li>\n<\/ul>\n<h2>Background to the current case<\/h2>\n<p>Kernpunkt der vorliegenden Auseinandersetzung war die Frage, ob die Antragstellerin die von ihr vor dem Landgericht Berlin erwirkte einstweilige Verf\u00fcgung ordnungsgem\u00e4\u00df vollzogen hatte. Das Problem: Die beglaubigte Abschrift, die der Gerichtsvollzieher der Antragsgegnerin letztendlich zugestellt hatte, war unvollst\u00e4ndig. Die zweite Seite des Beschlusses war versehentlich mit einer anderen Seite vertauscht worden.<\/p>\n<p>The Regional Court therefore revoked the interim injunction by judgment <i>(LG Berlin, Urteil v. 7.8.2018, Az. <a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=103%20O%2025\/18\" title=\"LG Berlin, 07.08.2018 - 103 O 25\/18: Wenn der Gerichtsvollzieher die zweite Seite der Antragssc...\">103 O 25\/18<\/a>, nicht rechtskr\u00e4ftig)\u00a0<\/i> upon objection by the defendant. We reported on the details of the current case here:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.lhr-law.de\/en\/magazine-en\/competition-law-antitrust-law\/if-the-bailiff-does-not-serve-the-second-page-of-the-application-on-the-difficulties-of-interim-injunction-proceedings-part-2\/\">If the bailiff does not serve the second page of the application &#8211; On the difficulties of interim injunction proceedings<\/a><\/li>\n<\/ul>\n<p>In response to the appeal lodged by the applicant against the judgment, the Court of Appeal announced in its decision dated May 3, 2019 that it intended to dismiss the appeal unanimously due to obvious futility pursuant to <a href=\"https:\/\/dejure.org\/gesetze\/ZPO\/522.html\" title=\"&sect; 522 ZPO: Zul&auml;ssigkeitspr&uuml;fung; Zur&uuml;ckweisungsbeschluss\">\u00a7 522 Abs. 2 S. 1 ZPO<\/a> <i>(KG Berlin, Hinweisbeschluss v. 3.5.2019, Az. <a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=5%20U%20118\/18\" title=\"5 U 118\/18 (3 zugeordnete Entscheidungen)\">5 U 118\/18<\/a>, nicht rechtskr\u00e4ftig)<\/i>.<\/p>\n<p>The Senate assumes that the applicant has neither succeeded in proving nor in substantiating that the injunction was served in full.<\/p>\n<h2>Postal delivery certificate does not prove completeness of the delivered documents<\/h2>\n<p>Die von ihr daf\u00fcr herangezogene Postzustellungsurkunde sei zwar als \u00f6ffentliche Urkunde grunds\u00e4tzlich in der Lage vollen Beweis f\u00fcr die in ihr enthaltenen Tatsachen zu erbringen. However, its probative value only extends to the fact that a certain document was delivered to a certain addressee at a certain time, but not to the disputed question of whether the documents were delivered in full.<\/p>\n<p>The defendant had also fulfilled a conceivable secondary burden of proof by describing the documents received in writing and submitting a copy of them, and had also substantiated the absence of page 2 of the application in the certified copy served by means of an affidavit by its managing director.<\/p>\n<h2>The absence of a page renders the execution ineffective<\/h2>\n<p>Die Zustellung einer Gerichtsentscheidung m\u00fcsse nicht zwangsl\u00e4ufig unwirksam sein, wenn die \u00fcbersendete Abschrift unvollst\u00e4ndig ist oder Fehler aufweist, so dass KG. Small errors and minor deviations are not detrimental if the recipient can recognize the content of the original and the scope of his complaint or the content and scope of the prohibition from the copy sent to him. However, the absence of several or even just a single page is typically regarded as a significant defect.<\/p>\n<h2>Conclusion<\/h2>\n<p>The assertion of competition law claims is &#8211; contrary to the current discussion about alleged warning letter abuse &#8211; anything but simple, even after a warning letter and successful application for an injunction.<\/p>\n<p>Aside from the fact that the common impression, which is repeatedly circulated by the <a href=\u201chttps:\/\/www.lhr-law.de\/patent-law\/wie-journalisten-unserioese-berichterstattung-zur-auflagensteigerung-missbrauchen\/\u201d>media, that \u201cwarning letters\u201d or their lawyers could casually make money from any careless mistakes in the legal notice or in the withdrawal policy<\/a>, the pursuit of injunctive relief requires extensive knowledge of the relevant regulations and case law.
